Terms for Professionals

1. ACCEPTANCE OF TERMS
1.1 Overview
These terms and conditions govern the use of WFCN's services by Filmmakers and Film Professionals. Acceptance of these terms is required for accessing and using the Services. Continued use implies agreement to any changes in the terms.
1.2 Modification
WFCN reserves the right to modify these terms at any time. Users are responsible for checking and accepting changes. Failure to agree with modified terms allows users to cease using the Services.
1.3 Language
All terms, including the Terms of Service and Privacy Policy, will be in English, the global medium of communication.
2. DESCRIPTION OF WFCN
WFCN facilitates submissions, payments, and registrations for film festivals and events. This T&C applies to Filmmakers and Film professionals. Festivals have a separate Terms of Service Agreement.
3. YOUR USE OF THE SERVICES
3.1 The Services
Users are granted a non-exclusive right to access and use the Services for browsing, submitting, purchasing, and interacting with registered festivals. Users must comply with the T&C and applicable laws.
3.2 Software
If allowed, users may download and use Software for internal use. The Software is subject to Singapore export controls. Users are responsible for compliance with laws and regulations.
4. PAYMENT
4.1 Independent Relationship of FPMs
Financial transactions are conducted through third-party payment methods (FPMs). Festivals and Filmmakers are bound by the terms of use of the chosen FPM.
4.2 Refunds
Refund policies are the responsibility of the Festival. Filmmakers must request refunds directly from the Festival. WFCN is not liable for refund-related issues. On any issues related to WFCN, please refer to Refund Policy to receive your return.
5. YOUR REGISTRATION OBLIGATIONS
Users agree to provide accurate registration information and update it promptly. WFCN may suspend or terminate accounts with inaccurate information. Users must be at least 18 years old to register, considering the legal age of majority in their jurisdiction.
6. ACCOUNT, PASSWORD, AND SECURITY
Users are required to create a password and account during the registration process. They are responsible for maintaining the confidentiality of their password and account. Users are also fully responsible for all activities under their account, including those by sub-users. Immediate notification of unauthorized use or security breaches is mandatory. WFCN is not liable for losses arising from failure to comply, and in case of disputes, WFCN's decision is final.
7. CONTENT
7.1 Site Content
All content delivered through the Services, collectively known as "Site Content," is protected by intellectual property and proprietary rights. Users agree not to sell, license, modify, distribute, or create derivative works of Site Content without explicit authorization from WFCN. Unauthorized use is strictly prohibited.
7.2 Your Content
Users grant WFCN a non-exclusive, worldwide, perpetual, royalty-free license to use and distribute the content they contribute to the site ("Your Content"). WFCN reserves the right to remove any content that violates the Terms and Conditions. Users retain copyright and ownership of their work. The use of WFCN services does not transfer ownership of intellectual property.
Community Guidelines:
- Share Only Original Content:
Users should only share content they've created or have the right to share. Posting authentic content and avoiding posting copyrighted material from the internet is emphasized.
- Appropriate Content for Diverse Audience:
Users are encouraged to post content suitable for a diverse audience. Nudity, pornographic material, and sexually explicit content are prohibited. Exceptions are made for certain contexts like breastfeeding, health-related situations, or acts of protest.
- Use Accurate Information:
While users don't have to use their real names, providing accurate and up-to-date information is mandatory. Impersonation and creating accounts to violate guidelines or mislead others are not allowed.
- Follow the Law:
Users must adhere to the law. Activities like supporting terrorism, organized crime, hate groups, selling firearms, drugs, or engaging in online gambling are strictly prohibited. Sharing child porn is not tolerated.
- Respect Others:
Users should respect others in the community. Content containing threats, hate speech, personal information intended for harassment, or repeated unwanted messages is removed. Encouraging violence based on various attributes is strictly forbidden.
- Thoughtful Posting of Newsworthy Events:
Posting newsworthy events is allowed, but users are encouraged to be thoughtful, especially when graphic content is involved. Graphic violence may be removed to maintain the platform's appropriateness for diverse users.
- Reporting Violations:
Users are encouraged to report content that violates guidelines. WFCN has a global team to review and take appropriate action. Users can also unfollow or block individuals whose content they find objectionable without violating guidelines.
8. CONDUCT
8.1 Certain Restrictions
Users, whether Filmmakers or other Non-Festivals, are responsible for all content they provide or make available through the Services. They agree not to use the Services to:
- Upload, post, or transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or objectionable content.
- Harm minors or facilitate gambling, gaming, lotteries, raffles, or sweepstakes, except for contests complying with WFCN's guidelines.
- Impersonate any person or entity or forge headers to disguise the origin of content.
- Upload, post, or transmit content without the right to do so under law or contractual relationships.
- Infringe on intellectual property rights.
- Upload, post, or transmit content related to the sale of goods and services, excluding event submissions and registrations on the site.
- Intentionally violate any law or stalk/harass any person or entity.
8.2 Certain Remedial Rights
WFCN has the right to monitor, alter, edit, or remove user content and terminate user rights to use the Services. WFCN may preserve and disclose user content for legal reasons. Users acknowledge the discretionary powers of WFCN in these matters.
9. SPECIAL ADMONITIONS FOR INTERNATIONAL USE
Users agree to comply with local rules regarding online conduct and content. WFCN is subject to Singapore export controls, and users represent they are not located in a country under Singapore's embargo.
10. INDEMNITY
Users agree to defend, indemnify, and hold WFCN harmless from any damage, loss, liability, cost, or expense resulting from claims related to user content, use of the Services, or violation of the Terms and Conditions.
11. SERVICE MODIFICATIONS/SUSPENSIONS
WFCN reserves the right to modify, suspend, or discontinue the Services with or without notice. Users acknowledge that WFCN is not liable for any such modifications, suspensions, or discontinuances.
12. TERMINATION
WFCN may terminate user accounts and access to the Services at its discretion, with or without notice, for various reasons outlined in the Terms and Conditions.
13. LINKS
WFCN is not responsible for the availability or content of third-party websites linked through the Services.
14. DISCLAIMER OF WARRANTIES
WFCN disclaims all warranties, and users acknowledge that the Services are provided "as is." WFCN is not responsible for the quality, safety, or legality of events and festivals listed on the platform.
15. LIMITATION OF LIABILITY
WFCN is not liable for indirect, incidental, special, or exemplary damages. The total liability for any claims related to the Services is limited to USD 100. Users acknowledge WFCN's limited liability.
16. RELEASE
Users release WFCN from all damages, losses, liabilities, costs, and expenses arising from disputes with third parties related to the Services.
17. PRIVACY
User information is governed by WFCN's Privacy Policy, incorporated into the Terms and Conditions. Users are advised to review the Privacy Policy closely.
18. NOTICE
Notices to users may be made via email or regular mail. Users are advised to check notices displayed on the Services.
19. TRADEMARK INFORMATION
The trademarks, service marks, and logos of WFCN are protected, and users must seek consent for any use. Other trademarks may be owned by third parties.
20. GENERAL
- Entire Agreement: The Terms and Conditions constitute the entire agreement, superseding any prior agreements or communications.
- Choice of Law: The agreement is governed by the laws of Singapore.
- Arbitration: Disputes are subject to binding arbitration in Singapore.
- No Class Actions: Claims must be brought on an individual basis, and class actions are not permitted.
- Waiver; Invalid Provisions: Failure to enforce rights doesn't constitute a waiver. If any provision is found invalid, other provisions remain in effect.
- Time to File Claim: Any claim must be filed within two years of arising.
- Titles: Section titles are for convenience and have no legal effect.
